Often times individual States or municipalities may have jurisdiction over wetlands and waters along with the US Army Corps of Engineers and in some cases this jurisdiction may not align with the US Army Corps of Engineers’ jurisdictional footprint. It is critical at the onset of a project to determine if any State or local agencies may have jurisdiction over any wetlands or waters on a site and whether their definition of wetlands may differ from that of the US Army Corps of Engineers.
In addition, during the Section 404/10 permitting process with the Army Corps of Engineers, certain state, or local pre-requisite permits, unrelated to wetland jurisdiction, such as DEQ approvals, cultural resource approvals, scenic rivers permit approvals etc., may be required prior to the US Army Corps of Engineers issuing a final permit approval.
